Subpoena and Legal Hold Management

Praxi provides a comprehensive workflow to help practices respond to subpoenas, court orders, and other legal requests for clinical records. From initial intake through AI-assisted review, redaction, privilege assessment, and document bundling, each step is tracked and audited.

Receiving a Subpoena

When your practice receives a subpoena or court order:

  1. Navigate to Legal & Records from the main sidebar
  2. Click Record Subpoena
  3. Enter the details:
    • Client -- the client whose records are subject to the subpoena
    • Court or tribunal -- select from the court registry or enter a custom court name
    • Subpoena type -- subpoena for production, subpoena to attend, or both
    • Case number and case title
    • Date received and return date (response deadline)
    • Requesting party and solicitor details (name, firm, email, phone)
    • Subpoena target -- whether the subpoena is directed at the practice or an individual practitioner
    • Conduct money -- amount received and payment status
    • Client notification -- whether client notification is required or prohibited by the court
  4. Save to begin the subpoena workflow
info

Creating a subpoena record automatically places a legal hold on the affected client's records. Normal data retention policies are suspended for the duration of the hold. :::

Subpoena Workflow

Praxi guides you through a structured workflow with the following stages:

StageDescription
ReceivedSubpoena logged, legal hold activated
Validity CheckReview whether the subpoena is valid and properly served
AssignedAssign the responsible practitioner to prepare the response
Client NotifiedClient informed about the subpoena (unless notification is prohibited by the court)
Scope DefinedDefine exactly which records fall within the subpoena's scope
Data GatheredPraxi collects all in-scope records automatically
AI ReviewAI assists with identifying potentially privileged content
RedactionApply redactions for out-of-scope or third-party information
Privilege ReviewLegal review of any privilege claims before production
SignedPractitioner signs off on the production
PackagedDocument bundle generated as a PDF package
DeliveredBundle sent to the requesting party or court
ClosedMatter resolved, hold released

At any stage, a subpoena can also be moved to:

  • Challenged -- if the practice objects to or challenges the subpoena
  • Withdrawn -- if the subpoena is withdrawn by the issuing party

If a challenge is resolved, the workflow returns to the Scope Defined stage.

When a legal hold is active on a client record:

ActionEffect
Record deletionBlocked until hold is released
Data retention expirySuspended
Record modificationPermitted but all changes are logged with enhanced audit detail
Erasure requestsQueued but not executed until hold is released

Preparing Records

Automatic Data Gathering

When the subpoena reaches the Data Gathered stage, Praxi automatically collects all records matching the defined scope:

  • Clinical notes and progress notes
  • Assessment results and reports
  • Correspondence (letters, referrals)
  • Appointment history
  • Consent records
  • Billing records (if within scope)
  • Access logs — a tender-ready record of who viewed the client's health information (if within scope)

AI-Assisted Review

Praxi's AI review assistant scans the gathered records and flags:

  • Content that may be subject to legal professional privilege
  • Third-party information that should be redacted
  • Content that appears outside the scope of the subpoena
warning

AI-flagged items are suggestions only. A qualified practitioner and, where appropriate, legal counsel must review and confirm all redactions and privilege claims. :::

Redaction

Before producing records, redact information that is outside the subpoena's scope or protected by privilege:

  1. In the record preparation view, click Redact on any document
  2. Use the redaction tool to black out specific text or sections
  3. Add a redaction reason (e.g., "Third-party information", "Outside scope of subpoena", "Legal professional privilege")
  4. Redactions are applied to the production copy only -- the original record is preserved unchanged

Privilege Review

After redaction, the Privilege Review stage allows legal counsel to review:

  • All privilege claims made during the redaction stage
  • The basis for each privilege assertion
  • Whether any additional redactions are needed

Signing and Packaging

Once review is complete:

  1. The responsible practitioner signs off on the production
  2. Praxi generates a paginated, indexed PDF bundle
  3. The bundle includes a cover sheet, index, and all in-scope documents with redactions applied
  4. A privilege log is also generated, listing all documents where privilege was claimed along with the basis for each claim
  5. Download the bundle for delivery to the court or requesting party

Insurer Notification

If your professional indemnity insurance requires notification when a subpoena is received:

  1. Open the subpoena record
  2. Click Notify Insurer
  3. Praxi records the date and time the insurer was notified for your audit trail

Time Tracking and Billing

Praxi tracks time spent on subpoena preparation for cost recovery:

  • Log time entries against each subpoena with descriptions
  • Generate a cost summary for invoicing or fee recovery
  • Time entries are linked to the subpoena record for audit purposes

Comments

Add comments to the subpoena record to document decisions, communications, and progress. Comments create a chronological record of all activity related to the subpoena response.

Task Management

Praxi creates compliance tasks throughout the subpoena workflow:

  • Deadline reminders for the response due date
  • Tasks for each stage requiring practitioner action
  • Escalation alerts if deadlines are approaching

Once the legal matter is resolved:

  1. Open the subpoena record
  2. Advance to the Closed stage
  3. Enter the resolution details and date
  4. Normal data retention policies resume for the affected records
tip

Seek legal advice before producing records. A solicitor can advise on what must be produced, what can be legitimately withheld, and whether any privilege applies. :::

Permissions

Subpoena access is permission-based, so your practice controls exactly who can do what. By default:
